1. Acceptance of Terms

By downloading, installing, or using Emojify Image ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Description of Service

Emojify Image is an iOS application that uses Google's Gemini AI (via Firebase Cloud Functions) to analyze photos you select and suggest relevant emojis. You can then overlay those emojis on your photo using the built-in canvas editor and export or share the result.

The App requires an internet connection to generate emoji suggestions. The canvas editor and export features work offline.

3. Eligibility

You must be at least 13 years old (16 in the EU/EEA) to use this App. By using the App you confirm you meet the applicable age requirement.

4. Your Content

  • You retain full ownership of any photos you use with the App.
  • By submitting a photo for analysis, you grant us a limited, transient license to process that photo solely for the purpose of generating emoji suggestions in that session. The photo is not stored on our servers after the response is returned.
  • You are responsible for ensuring you have the right to use any photo you submit (e.g. you took it, or have permission from the copyright holder).
  • Do not submit photos containing illegal content, content that violates third-party rights, or content depicting minors in a manner that violates any law.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law or regulation
  • Submit photos containing nudity, graphic violence, hate content, or material that violates Google's AI usage policies
  • Attempt to reverse-engineer, decompile, or extract the App's source code
  • Use automated tools to make generation requests in excess of normal human usage
  • Circumvent rate limits, App Check verification, or other security measures

6. AI-Generated Content

Emoji suggestions are generated by Google's Gemini AI model. AI output may be inaccurate, incomplete, or unexpected. We make no guarantee that suggestions will be appropriate, relevant, or free of errors. You are responsible for reviewing AI-generated content before sharing it.

The App relies on Google Firebase and Google Gemini AI. Your use of these services is also subject to Google's terms:

8. Intellectual Property

All App code, design, branding, and non-user-generated content are owned by the developer. Nothing in these Terms grants you a right to use our trademarks, logos, or branding.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT AI SUGGESTIONS WILL MEET YOUR EXPECTATIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED €10 (TEN EUROS).

11. Indemnification

You agree to indemnify and hold harmless the developer from any claims, losses, or damages (including legal fees) arising from your use of the App or your violation of these Terms.

12. Changes to the App or Terms

We may update the App or these Terms at any time. Continued use of the App after an update constitutes acceptance of the revised Terms. We will update the effective date at the top of this page when the Terms change.

We reserve the right to modify, suspend, or discontinue the App (or any feature) at any time without notice.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the developer is based, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction, unless applicable consumer protection law in your country requires otherwise.
